        During the last decade, I have written several academic and general articles on the monarchy, and have spoken publicly about this issue. I have never used these occasions to propose the so called “lom chao” or “overthrowing the monarchical institution.” Each and every one of my public statement and written work is premised on the assumption of the continuation of the monarchy. At the same time, I do not conceal my view concerning the need to transform and adapt the monarchy according to the principles of democratic governance, the rule of law, and the advances of the modern world. The law permits people to express their views or make recommendations concerning the necessity of transforming and adapting the monarchy. Such acts are not illegal; they break neither the constitutional nor criminal law. For this reason, I have always written and spoken about this issue under my real name. At the beginning of 2010, I presented my view concerning the reform of the monarchy as an eight-point proposal, which I subsequently made available to the public. The proposal was widely read. On February 21, 2010, Senator Kamnoon Sitthisamarn, for one, reproduced it, accompanied by his commentary, in Manager newspaper.

        The talk I gave on December 10, 2010, and any statement or writing I have produced since then, have all been within the framework of these eight concrete, legally justifiable, proposals concerning reforming the monarchy.

        However, if state officials, whether of the civilian or military variety, are of the opinion that I have broken the law, I would be happy to clarify my position and defend my case according to all due legal process. It has never occurred to me to evade any accusations. It is a well-known fact that I am prepared to openly debate and exchange opinions with fellow citizens who hold opposing views. I have engaged in such public exchanges on many occasions.

        Over the past two weeks or so, state officials have been increasing tension with their references to the accusation commonly referred to as “lèse majesté.” In an interview dated April 7, the Commander in Chief attacked “a mentally ill academic” who “is intent on overthrowing the institution.” Since April 10, the military has been giving interviews and loudly demonstrating its might on a daily basis. Such gestures, though they do not directly target me, have created a climate of fear in Thai society regarding the monarchy. A development that directly concerns me is the comment, made in private, by a leading government figure that the military has been putting pressure on that person to specifically persecute me. Additionally, well-placed officials have revealed that preparations are being made to bring charges against me.

        As I stated earlier, none of my actions regarding this issue are illegal. However, a climate of fear has been created by the military’s daily display of might. Within this context, there have been unusual occurrences which have directly targeted me.

        For instance, earlier this week two men on separate motorbikes were twice spotted surveying the area near my house. When the security guard in my housing estate enquired why they were there, they replied that they had come to “pick up ajarn (professor).” They did not claim to be officials and did not show any official documents. Additionally, an anonymous phone call was made to my house warning me to be careful. The caller claimed that a certain security department has ordered a large number of its officials to closely monitor my movements round the clock, and to be ready to arrest me immediately upon receiving the order.

        I would like to emphasise that I have always expressed my opinions, and my proposals, concerning reforming the monarchy in an open manner, always according to the framework permitted by law. However, given these unusual developments of recent days, I feel it is necessary to communicate to the press and the public, and via them to state officials, that the right to express views about and to comment on the institution of the monarchy is legal according to the international human rights principle, and even according to the principle of the Thai constitutional law. As for the usage of the problematic law known as “lèse majesté,” if there are plans to bring this accusation upon myself or others, the prosecution should respect due legal process. The fuelling of the climate of fear must stop, as it is this which licenses the usage of extra legal forces in whatever form, whether against myself or others who have been accused. The military’s repeated display of force over the past ten days or so under the claim of preventing “lèse majesté” does not subscribe to legal principles. The outcome it encourages is that carried out via extra legal measures.

        I maintain that I have always acted publicly and in good faith. If state officials deem it necessary to do so, they are able to call me in for questioning. I am always prepared to clarify myself and answer any questions they may have. The issuing of an arrest warrant is unnecessary, as is the monitoring of my movements or the usage of various measures of questionable legal status to increase the tension. If I am to be prosecuted, I will be prepared to claim my right to legal defense and will apply for bail. I have never considered escaping or evading the accusation as I am an employee of the state with academic teaching and research responsibilities. I believe that my action establishes a correct standard of conduct, both for myself and others, concerning this issue.

        The 84-year-old guru died following heart and respiratory problems, which had left him in a critical condition for the past three weeks.


        Satya Sai Baba is thought to have millions of followers around the world.

        He was admitted to a hospital in his hometown of Puttaparthi last month. After initially showing signs of improvement, his condition worsened.

        Sai Baba counts former Indian prime ministers, prominent businessmen and cricketers among his followers, many of whom consider him a living god.

        But his career has also been dogged by controversy. He has been accused of faking some of the so-called miracles attributed to him.

        And some former followers have levelled accusations of sexual abuse against him and other members of his ashram - charges that he has denied.

        He has never been charged by police in connection with these allegations.

        Political activists and associates of high-profile Thammasat University historian Somsak Jiamteerasakul have reacted with shock to the lese-majeste charge filed against him.


        They warned that charging one of the Kingdom's best-known critics of the lese-majeste law by using that law is "short-sighted" and will "backfire".

        Vipar Daomanee, a fellow academic at Thammasat University, said: "Somsak has always been careful [in expressing himself] and the fact that the ruling class is using this law is short-sighted, blind and dictatorial."

        Vipar warned that the issue would likely become "internationalised" and widen the current political division. She added that Somsak always cited detailed academic texts and facts whenever he criticised the law or the institution.

        Somsak, who finished his doctoral education in Australia and enjoys a cult following among leftists, announced on Facebook yesterday that he would hold a press conference at 2pm today to discuss the charge and how it impacts his academic freedom at Thammasat University's Law Faculty.

        Somsak had made a much-talked about speech on December 10 last year regarding the Thai monarchy and the Constitution. He stated on his Facebook page that the public lecture was the basis for the lese-majeste charge. Somsak could not be reached at the time of going to print.

        David Streckfuss, a Khon Kaen-based expert on the lese-majeste law, who last year wrote an academic book about the controversial law, warned that the charge will eventually "backfire" against the elite.

        "Striking against red-shirt leaders is one thing but striking against an academic is another," said Streckfuss, adding that Somsak and his group's approach to criticisms are "very measured".

        Thanapol Eiwsakul, editor of the leftist Fah Diew Kan magazine, which published some of Somsak's articles, said the lawsuit is tantamount to harassment.

        Thanapol claimed that Somsak had been receiving threatening phone calls of late and some unknown motorcyclists also drove in front of his home to harass him. "On one hand, the law is used to threaten others, now even someone like Somsak has been sued."

        Although the mainstream media have ignored most of Somsak's critical speeches and writings up until now, he enjoys a large following both on and off-line through the Internet and alternative media such as Fah Diew Kan and Prachatai.com. Thanapol said the news bout Somsak being charged is already spreading fast.

        On Prachatai.com, a non-profit online newspaper website, the news was announced yesterday with some praising him and others condemning him.

        "Please admit your guilt," a reader posted under the pen name 'Rim Ping Lady'.

        Another, using the name 'Green Lantern', wrote: "I hope your incarceration will awake tens or hundreds of thousands of people into bringing about a major change that we have long been awaiting."

        SAMRONG (Cambodia) - HEAVY fighting erupted again on Saturday on the Thai-Cambodia border, leaving 10 soldiers dead in two days - the worst bloodshed since a UN appeal in February for a permanent ceasefire.


        The two neighbours have fought a series of deadly gunbattles in recent years in disputed jungle near ancient temples along the frontier, which has never been fully demarcated, partly because it is littered with landmines.

        Three Cambodian troops and one Thai soldier were killed on Saturday, according to officials in the two countries, a day after three died on each side.

        The Cambodian defence ministry accused Thailand of using 75mm and 105mm 'heavy guns loaded with poisonous gas", but gave no further details and the claim could not be independently verified. The Thai army denied the allegation.

        Thailand recently admitted using controversial Dual Purpose Improved Conventional Munitions during the February fighting but insisted it did not classify them as cluster munitions.

        BANGKOK: Thailand's fugitive ex-leader Thaksin Shinawatra on Saturday urged the military not to meddle in politics and pledged allegiance to the throne as he outlined the opposition's election platform.


        The former billionaire telecoms tycoon was ousted in a 2006 military coup and lives overseas to avoid a jail term imposed in absentia for corruption, but is widely seen as the de facto leader of the opposition Puea Thai party.

        He called for a free and fair election in an address by video link to a Puea Thai party meeting.

        "The military must not intervene to set up a government like last time when it formed a government in the barracks," added Thaksin, who said he was speaking from Dubai.

        Thai Prime Minister Abhisit Vejjajiva, who came to power in a 2008 parliamentary vote with the backing of the military, has said he expects a general election to be held by early July.

        Thai society remains bitterly divided almost a year after more than 90 people died in street clashes between "Red Shirt" opposition protesters - many of whom seek the return of Thaksin - and armed troops in central Bangkok.

        In remarks which appeared to be aimed mainly at the Red Shirt leaders, Thailand's army chief General Prayut Chan-O-Cha recently warned political figures to keep the revered monarchy out of the election debate.

        He said that the military "will do its duty to protect the monarchy".

        Prayut has pledged to abide by the results of the election and has brushed aside rumours of a military coup.

        But that has not dampened speculation about possible military intervention in a country that has seen 18 actual or attempted coups since 1932.

        Thaksin stressed his support for the Thai royal family, which has no official political role but is seen as a stabilising force in the kingdom.

        "I want to reassure you that I am loyal to the monarchy, no matter what allegations they have tried to make against me," he said, adding that he agreed that the royal family should not be dragged into the election debate.

        Thaksin said he was confident that Puea Thai would win the upcoming election, saying it would eradicate drug problems within a year and eradicate poverty in the next four years if elected.

        Thaksin is hailed by many rural and working class Thais for his populist policies for the masses but loathed by the Bangkok-based elite, which sees him as corrupt, authoritarian and a threat to the revered monarchy.

        Yingluck Shinawatra, a sister of the ousted ex-premier, has emerged as a possible opposition candidate for prime minister, but Thaksin did not reveal who he would be putting forward for the leadership.

        DAMASCUS - Two Syrian MPs from the protest hub city of Daraa on Saturday told Al-Jazeera television they were quitting parliament in protest at the bloodshed in their country.


        "I announce my resignation from parliament," Khalil al-Rifai, a deputy from the southern city said in remarks broadcast by Al-Jazeera.

        The satellite channel said he became the second MP from Daraa to quit after Nasser al-Hariri, who earlier announced his resignation also on Al-Jazeera, saying he was frustrated because he could not protect his constituents.

        Rifai echoed the sentiment, saying he could not "protect the people who brought me to parliament."

        "I urge the president to intervene immediately," said Rifai, who became the first MP to quit since anti-regime protests in the country erupted on March 15.

        At least eight people were killed on Saturday in Syria, activists and witnesses said, as tens of thousands took to the streets again to bury scores of people killed in massive anti-regime protests the previous day.

        Many of those killed Friday and Saturday fell in the region of Daraa, in the south of the country.
